ORDINANCE # 4 OF 2000

AN ORDINANCE TO ESTABLISH SNOW REMOVAL CONDITIONS

AND TIMES FOR THE TOWN OF WINAMAC, INDIANA

WHEREAS, accumulations of snow and ice on Winamac’s streets and roads represent a potential threat to the health, safety and general welfare of Winamac residents, and;

WHEREAS, the Town Council of the Town of Winamac deem it appropriate to establish snow removal regulations and designated snow removal times within the Town of Winamac, and;

WHEREAS, inoperable, abandoned or parked vehicles located on public roads and streets in Winamac hinder the timely and efficient removal of ice and snow by the Winamac Street Department:

NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Winamac, Indiana, that the following Ordinance shall be adopted:

SECTION 1

SNOW REMOVAL CONDITIONS

(A) When, in the opinion of the Winamac Street Department Superintendent and the Winamac Town Manager, the actual or expected precipitation of snow will create hazardous or dangerous roadway conditions for vehicular or pedestrian traffic, the Winamac Town Manager shall have the authority to declare a snow removal condition.

(B) A snow removal condition shall be declared by the Winamac Town Manager by issuing a media release to the local radio, and cable television stations.

(C) The snow removal condition shall continue in force and effect until the Winamac Town Manager declares it to be over by issuing a media release to the local radio and cable television stations.

SECTION 2

PARKING RESTRICTIONS DURING SNOW REMOVAL PERIODS

(A) When a snow removal condition has been declared, the following traffic regulations will be in effect for all streets except for the following:

Adams Street between Logan St. & Riverside Dr.

Jefferson Street between Logan St. & Riverside Dr.

Main Street between Logan St. & Riverside Dr.

Pearl Street between Logan St. & Riverside Dr.

Logan Street between Spring St. & Adams St.

Market Street between Spring St. & Adams St.

Monticello Street. between Spring St. and Adams St.

    1. All regular parking restrictions will remain in force. Such as 2-hour parking limits, and all no-parking areas.
    2. On even numbered days from 8 a.m. till 6 p.m., parking will only be permitted on the side of the street with even numbered addresses.
    3. On odd numbered days from 8 a.m. till 6 p.m., parking will only be permitted on the side of the street with odd numbered addresses.
    4. These restrictions will remain in force until the snow removal condition has been declared over as in Section 1, Part (C), or the snow has been removed from curb to curb for the entire length of the street.
    1. Any vehicle parked, stalled, incapable of moving under its own power, or left unattended on any street in violation of section (A) herein shall be ticketed, towed, or impounded.

SECTION 3

OWNER/OCCUPANT TO REMOVE SNOW

    1. The owner or occupant of any lot or parcel of land lying within the area designated below shall keep the sidewalks of the lot or parcel of land clean at all seasons of the year. In addition, after any fall of snow the owner/occupant shall remove the snow or cause it to be removed from the sidewalk within 48 hours after the snow has fallen.

    Monticello Street. between Spring St. and Adams St.

    SECTION 4

    PENALTY

    Any person who violates this ordinance shall be fined not less that twenty-five dollars ($25) for each offense or more than fifty dollars ($50) for any single offense. Each day that the violation remains shall constitute a separate offense.

    SECTION 5

    PAYMENT OF CIVIL PENALTIES

    Civil penalties for violation(s) of this ordinance shall be payable through the Winamac Clerk-Treasurer’s Office located at 120 W. Main St., Winamac, Indiana, within thirty (30) days.

    SECTION 6

    SAVINGS CLAUSE

    If any section, provision or part of this ordinance shall be judged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any sections, provisions or part thereof not adjudged invalid or unconstitutional.

    SECTION 7

    EFFECTIVE DATE

    This ordinance shall be in full force and effect upon passage by the Winamac Town Council and publication as required by law.

    Adopted by the Town Council of the Town of Winamac, Indiana, this 27th day of November, 2000.
